What Is an Electronic Signature?
An electronic signature — also called an e-signature — is any electronic indication of a person's intent to agree to or approve the contents of a document. This includes drawing your signature on a screen, typing your name, clicking an “I agree” button, or uploading an image of your signature. What matters legally is the intent to sign, not the specific method used.
E-signatures are distinct from cryptographic digital signatures, which use certificate-based technology to verify identity and are required in specific regulated contexts. For the vast majority of everyday documents — contracts, NDAs, lease agreements, employment paperwork, invoices, and consent forms — a simple electronic signature created with SigPDF is legally sufficient.
Is an E-Signed PDF Legally Valid?
Yes. Electronic signatures have had the same legal standing as handwritten signatures for over two decades in most countries. The key legislation:
- United States — ESIGN Act (2000): The Electronic Signatures in Global and National Commerce Act gives e-signatures the same legal standing as handwritten signatures for most transactions across all 50 states. A contract or signature may not be denied legal effect solely because it is in electronic form.
- European Union — eIDAS Regulation (2014): eIDAS establishes three tiers of electronic signatures. SigPDF produces a Simple Electronic Signature (SES), which is sufficient for most commercial contracts, NDAs, rental agreements, and employment documents. An SES cannot be denied legal effect in the EU solely on the grounds that it is electronic.
- United Kingdom — Electronic Communications Act (2000): Electronic signatures are admissible in legal proceedings. Post-Brexit, the UK retained its own e-signature framework aligned with eIDAS principles.
- Canada, Australia, and most other countries have equivalent legislation — PIPEDA/provincial Electronic Commerce Acts in Canada, the Electronic Transactions Act in Australia — all recognizing electronic signatures on standard documents.
The main exceptions where electronic signatures may not be sufficient include wills, deeds to real property, and documents requiring notarization. These typically require witnessed or certified signatures regardless of the platform used.
